What this site is
This site collects first hand accounts from people who say they did business with Federico Pacquing or entities associated with him, and it reports what is on the public court record. It is a journalism and public information project. It is not owned, operated, endorsed, authorised, or reviewed by Federico Pacquing, The Pacquing Group, Pacquing Financial, or any entity associated with them.
Nothing on this site is legal, financial, investment, or professional advice of any kind, and nothing here creates a lawyer-client, adviser-client, or fiduciary relationship between you and anyone. If you believe you have lost money, speak to your own lawyer and report it to the authorities listed at the bottom of the main page.
We do not promise you anything
This is the part worth reading twice. Using this site does not put us under any obligation to you. Specifically, we do not undertake, and you should not assume, that we will:
- investigate, verify, or corroborate any account submitted to us;
- publish your submission, in whole or in part, or ever;
- publish it in the form you sent it, or on any timescale;
- keep anything published here online for any length of time;
- reply to you, acknowledge your submission, or keep you updated;
- pass anything to a regulator, a law enforcement agency, a lawyer, or a journalist;
- keep the site online, available, complete, current, or free of errors; or
- take, or refrain from taking, any particular action at all.
We may add, change, correct, redact, or remove anything on this site at any time, at our sole discretion, without notice and without explanation.
Accounts are the statements of the people who gave them
Where an account from a named individual appears on this site, it is that person’s own description of their own experience, published with their written permission. It is their statement, not ours. We do not adopt it, endorse it, or vouch for it, and we do not represent that it is accurate or complete. Where we say we have reviewed a specific document, we mean exactly that and nothing more: that we looked at the document named. It is not a statement that the rest of the account is true.
The court records section
The section describing court records is a report of public filings. It distinguishes between what a party alleged, what a court ordered, and what a defendant agreed to. Court records are voluminous, are sometimes amended or sealed after the fact, and summaries can go out of date. We do not warrant that the section is complete or current. Anyone relying on it should read the underlying filings, which are public and which we identify by case number so that you can.
If you submit something
By submitting an account through the form on this site, you confirm:
- that what you write is truthful to the best of your knowledge, and describes what you personally experienced or personally saw;
- that you have the right to send us everything you send, including any documents;
- that you are not sending it to harass, threaten, or intimidate anyone, and that you are not sending anything unlawful;
- that you are at least 18 years old; and
- that you grant us permission to store your submission and to contact you about it.
Submitting an account is not the same as agreeing to have it published. Nothing you send is published unless you separately sign a written release, and we keep that release on file. You can ask us to delete your submission at any time. How we handle your information is set out in the privacy policy, which forms part of these terms.
Corrections
If you believe anything on this site is inaccurate — including anything said about a person named here, and including by the person named here — write to info@FPacquingInquiry.com. Tell us what is wrong and, if you can, why. We read everything sent to that address and we will correct or remove anything we find to be inaccurate. That is a commitment about accuracy. It is not a commitment to remove material simply because someone objects to it.
Who operates this site
The people who operate this site are not identified on it. This is a deliberate choice and it does not affect the corrections process: mail to info@FPacquingInquiry.com reaches us and is read. Legal process should be directed to the same address in the first instance.
Third party links
This site links to court records, government agencies, and pages published by the people it describes. We do not control those sites, are not responsible for their content, and linking to a page is not an endorsement of it.
No warranty
This site is provided “as is” and “as available”, without warranty of any kind, express, implied, or statutory. We specifically disclaim the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be available, uninterrupted, secure, accurate, complete, or error free.
Limitation of liability
To the fullest extent the law allows, we will not be liable to you for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, data, goodwill, or opportunity, arising out of or connected to your use of this site or your reliance on anything published here, even if we have been advised that such damages are possible. Some jurisdictions do not allow these limitations, in which case they apply only to the extent permitted.
Indemnity
You agree to indemnify and hold us harmless from any claim, loss, or expense, including reasonable legal fees, arising out of your use of this site, anything you submit to it, or your breach of these terms.
Governing law
These terms are governed by the law of the State of California, without regard to its conflict of laws rules, and any dispute arising out of them or out of your use of this site shall be brought in the state or federal courts located in California.
Changes
We may change these terms at any time. Changes take effect when posted here, and the date at the top of this page will change. Continuing to use the site after that means you accept the revised terms.
